The current General Conditions concern the on-line purchase of products and services from Burn Out Italy of Calabrese Vincenzo (from now on called Burn Out Italy), with its registered office in Via Villa Maio no. 10 / int. 29 – 90131 – Palermo, VAT Number. 05776940828 – Fiscal Code: CLB VBN 83S15 G273Y) and owner of the website http://www.burnoutitaly.com. Each purchasing operation will be ruled by the regulations in compliance with the Legislative Decree No. 185/99, and as far as it concerns privacy protection, it will comply with the regulation concerning Law No. 675/96 and subsequent changes.
Acceptance of the general conditions of sale
By sending their orders through the website http://www.burnoutitaly.com or via e-mail, customers accept and undertake to comply with the current general conditions of sale. There may also be exceptions in which Burn Out Italy might inform its customers via e-mail or by phone that it doesn’t wish to accept their purchase order. All purchases are regulated by the current regulations complying with the Legislative Decree No. 185/1999 and by the provisions in matters of personal data protection, Law No. 196/2003, and subsequent changes. Sending a purchase order means that customers are totally aware and accept the current Sale conditions. Once completed the purchase procedure, customers will print or save an electronic copy and keep the current sale conditions, in compliance with articles 3 and 4 of the Legislative Decree 185/1999 concerning distance sales.
How to purchase
When surfing the website http://www.burnoutitaly.com, customers will be able to view and purchase all the products available on the price list, as described and represented in their related descriptive and technical cards. It is understood that the images and descriptions shown in the cards could not be entirely representative of the characteristics of the product and, in any case, we advise to consult the manufacturer for more precise and thorough information. Purchases are made through the use of the trolley with the relating order procedure, at the indicated price including VAT. During the ordering stage, the relevant contribution towards expenses is determined. Before the definite confirmation of the purchase order, a roundup of the order is shown, which also includes the price of the products being purchased, total forwarding charges, possible discounts or extra charges relating to the methods of payment accepted and the total amount due for the entire order. A serial number will be issued upon confirmation of the purchase and the customer will be able to print a detailed roundup of the order. The correct receipt of the order is confirmed by an e-mail which will be sent to the customer’s address. In case of a non-acceptance of the order, Burn Out Italy will soon inform the Customer. Burn Out Italy refuses all responsibility for compensation for damages or indemnity, as well as any responsibility for direct or indirect damages to people and/or things, caused by a non-acceptance, even if partial, or a delay in delivering an order.
Methods Of Payment
Burn Out Italy will execute an order only after receiving the payment. If the payment is not made within 48 hours from the time the order has been placed on-line, the order is considered null and the products in question will be put on sale again. If the customer chooses to use a bank transfer, he needs to indicate, in the reason for payment, the number of the order and the date of the order, and later to send us a copy of the receipt to our e-mail address.
Cancellation Of Orders
The entire order, or just for certain products, will be cancelled if:
- The product is no longer in the manufacturer’s catalogue;
- Excessive delay in the delivery of products by the supplier
- No advance payment if indicated by the customer
- Variations to rises in the price of the product by the supplier, which is more than 10 %
- Goods returned by the carrier for impossible delivery.
Right of Withdrawal
The right of withdrawal is regulated by the Legislative Decree No. 185/1999 if the Customer (that is an individual person who buys goods which are not needed for his professional activity, or rather he doesn’t mention his VAT number in the order form when making the purchase) has the right to withdraw from the contract for any reason. In order to exercise such right, the Customer will have to send to Burn Out Italy the goods within 7 days from the date of the receipt of the goods. The communication of withdrawal must be sent by registered letter with return receipt addressed to : Burn Out Italy di Calabrese Vincenzo, via villa maio n. 10 / int. 29 – 90131 – Palermo – Italy, such communication can also be sent in advance by e-mail, as far as it is confirmed by a registered letter with return receipt within 48 hours. Attention: Customers who purchase with their VAT Number cannot benefit from the right of withdrawal.
Modes of Withdrawal
The right of withdrawal is subject to the following conditions: the right is applied to the product purchased in its entirety;
- It is not possible to exercise a withdrawal only on a part of the product been purchased
- The right is not applied to audiovisual products or sealed computer software (including those attached to hardware material), once they have been open; the product purchased will have to be undamaged and returned in its original packaging, together with all its parts (including packaging and possible documents, and accessories: manuals, cables, etc.)
- To avoid damages to the original packaging, we recommend, when possible, to place it in a second box; no labels or adhesive tape should be directly put on the original packaging of the product
- According to the law, the forwarding charges related to the restitution of goods are to be paid by the Customer
- The Customer takes full responsibility for the delivery to our warehouse, until the receipt can be certified
- Should goods be damaged during the transport, Burn Out Italy will inform the Customer (within 7 working days from receipt of the goods in its warehouse), in order to allow him to take action against the carrier in good time and to obtain a refund for the value of the goods (if insured); in this case, the products will be put at the Customer’s disposal for their return, cancelling at the same time the claim for withdrawal
- Burn Out Italy is not to be held responsible for any damages or theft/loss of goods returned with uninsured consignments
- Upon their arrival to the warehouse, the products will be examined in order to establish possible damages or tampering which do not derive from transport. If the packaging and/or the original packing are ruined, Burn Out Italy will deduct a percentage from the refund due, which is not more than 30% than the refund itself, as a contribution towards the restoring expenses.
The following rules are applied to the right of withdrawal:
- The customer must be a private individual
- Goods must be delivered and not collected at the point of sale
- Goods must be undamaged, complete of all their parts, including packing (original external and/or internal packaging, accessories, detachable parts, cables, manuals, etc.)
- The right of withdrawal is applied to audiovisual products or to a computer software (including those attached to hardware materials) if the packaging is sealed and totally undamaged, or if bearing an undamaged SIAE stamp
- The forwarding charges refer to the restitution of goods to be paid by the customer
- The customer is fully responsible for the consignment of returned goods
- Should returned goods be damaged during transport, Burn Out Italy will soon inform the customer, so that he can take action against the carrier and demand possible refunds, seeing to the restitution of goods and cancelling the claim for withdrawal
- Should there be a loss of the right of withdrawal, Burn Out Italy will see to the restitution of the purchased products to the consignor and to the charging of forwarding costs.
Loss of Right of Withdrawal
The right of withdrawal is no longer valid when goods are damaged (packaging and/or its content), if the Customer, who has already paid for the entire amount, ascertains:
- the use, even partially, of the goods and possible consumables
- for the purchase or sale of items manufactured on purpose or created personally for the consumer
- the lack of external packaging and/or original internal packing
- the damage of the product for causes different from its transport
- the absence of integral elements of the product (accessories, parts, etc.)
- when the customer refuses to pay the forwarding charges for the restitution of the order.
Customers who purchase with their VAT Number cannot make use of the right of withdrawal. According to the Legislative Decree No. 185/1999, regarding mail order selling, if the customer is the end consumer he may use the right of withdrawal if the product is not to his liking within ten working days from receiving the goods, without having to give any explanation. Burn Out Italy will see to the refund of the value of the product or the replacement of the item with a similar product, according to the customer’s choice. Should the customer want to take advantage of such right, he needs to communicate it by sending a registered letter with return receipt within 10 days from the date the goods have been received. The registered letter must be sent to Burn Out Italy di Calabrese Vincenzo, via villa maio n. 10 / int. 29 – 90131 – Palermo – Italy. After receiving the registered letter, Burn Out Italy will inform the customer on the rules to follow for the restitution of goods. Carriage unpaid or unauthorized consignments are not accepted.
Returned Goods Procedures
Once the Customer has decided to make use of the right of withdrawal, the procedures to be followed set by Burn Out Italy are: Sending a registered letter with return receipt to the following address: Burn Out Italy di Calabrese Vincenzo, via villa maio n. 10 / int. 29 – 90131 – Palermo – Italy. Waiting for Burn Out Italy’s confirmation of receipt of the registered letter. Sending the package according to the illustrated modalities.
Refund
Except for possible restoring expenses for ascertained damages to the original packing, Burn Out Italy will refund the Customer the entire amount already paid, in the shortest possible time, and in any case within and not more that 30 days from receiving the communication of withdrawal. Therefore it will be the Customer’s responsibility to supply in time his bank details in which the refund can be paid (IBAN Code of the holder of the invoice).
Guarantees
Products purchased from Burn Out Italy are covered by the manufacturer’s guarantee (supplied according to the rules illustrated in the documents inside the packaging of the product). The guarantee applies to private customers (end consumer) who possess the purchase invoice. The guarantee applies to products with conformity defects and/or malfunctions not found at the time of the purchase, as far as the product itself is used correctly and with the due care, that is respecting its intended use and observing the various operating regulations indicated. Such guarantee will not be valid in case of negligence, carelessness when using the product and during its maintenance, or connection to electric systems not in conformity with the law. In case of a conformity defect, Burn Out Italy will see, with no expenses to be paid by the Customer, to the restoring of the conformity of the product through repair, replacement with a similar or better product, reduction in price. If after the intervention of an Authorized Assistance Centre, the fault doesn’t seem to be a conformity defect according to the Legislative Decree 24/2002, the customer will be debited with the possible verification and restoring costs required by the Authorized Assistance, as well as the costs of transport borne. The DOA replacements (Dead On Arrival: product non functioning upon delivery) are possible only if provided for by the manufacturer and according to the modalities and characteristics indicated by him.
How to proceed:
- The private customer will have to get in touch with Burn Out Italy and indicate the anomalies met
- Wait for the authorization for the return procedure
- Should the customer wish to return a product, he will have to send it back in its original packaging, with all its parts and original content, and in a suitable packaging which would avoid damages during transport.
- The customer will have to bear the forwarding expenses of the product and Burn Out Italy bears the expenses for sending the product to the customer’s address once restored.
It will be Burn Out Italy’s responsibility to collect the packaging through its own carrier and without additional charges. Once received the returned product, Burn Out Italy will see to the restoring of the conformity defect on the basis of the agreement taken place. Burn Out Italy is not to be held responsible for any delay in carrying out repairs or replacements.
